Driving licence: problems for those suffering from cardiomyopathy

The problem of renewing licenses for patients who have had a pacemaker or defibrillator implanted is really serious.

The first sure thing is that after the implantation of the device it is necessary to inform (by the patient) the motorization offices. Those who do not do so run the risk of having their own insurance company dispute the costs deriving from damages caused to third parties in the event of any accidents caused by the devices.

The second sure thing is that the license (or renewal) is issued or renewed by special commissions (generally presided over by a coroner) set up at the companies of the national health service.

The third sure thing is that getting your license issued (or renewed) is expensive: time to make an appointment and money, for bills to be paid and for medical certifications to be presented, for which it is often necessary to turn to private professionals, given the long waiting lists imposed for public services.

Beyond these certainties, chaos reigns.
There are no guidelines approved at national level by the competent institutions (ministry of health). If one asks for explanations, one generally hears the answer that the commissions refer to guidelines drawn up by scientific societies. The most popular one is called AIAC, an acronym which means (Italian Association of Arrhythmology and Cardiostimulation). It turns out that AIAC is a subject of private law, perhaps an authoritative one. But if its guidelines are not implemented by the ministry of health or by the regions, however authoritative, they do not give any certainty to patients (rights) and professionals who must issue or renew their driving license (duties).
The result is chaos: each region becomes its own kingdom. And even within the regions, each health agency essentially goes its own way. And here comes renewals of a few years and renewals of six months. The motivation? Like the phoenix: "everyone says it exists, where it is no one knows" (Mozart, Cosi' fan tutte). Aicarm will try to take this typical problem in Italian sauce by the horns.

Patient care information

In the presence of a new diagnosis of cardiomyopathy, it is advisable to inform your insurance company to evaluate any change in the risk associated with the disease and avoid coverage problems in the event of accidents.

After the implantation of a pacemaker or a defibrillator, the patient must inform the DMV on his own behalf.

Considerations

It is true that the commissions take responsibility for the issuance/renewal of the license but the your right to a fair and reasonable judgment of one's eligibility on the basis of scientifically approved and updated guidelines (we consider that many cardiac pathologies were almost unknown until a few years ago), so for example in the case of renewal, no no distinction between an ICD implant in primary or secondary prevention.

So, undoubtedly there is a lot of confusion: there has already been a law for at least 12 years which was supposed to lead to the drafting of guidelines within 6 months, then we implemented a European directive in 2018 which essentially does not change much, it only seems to better specify the pathologies involved in the question of licenses.

Substantially there is a lack of guidelines to guarantee people's rights and the transparency of assessments by local medical commissions.

Valerio Pellini

Valerio Pelini was born in Figline Valdarno on 14 May 1951 and still resides there.

Currently retired, he is a founding member of Aicarm Onlus and has been a member of the Board of Directors since the foundation of the association. He also carries out an intense volunteering activity in other associations.
Graduated in literature with a historical address, he was from 1996 to 2009 Director General of the Tuscany Region and from 2010 to 2014 Director of the Municipality of Florence.
He carries one Obstructive cardiomyopathy diagnosed over 25 years ago.
In addition to the activities carried out in the Board of Directors, Valerio deals with institutional relations with public bodies. Furthermore, he is particularly engaged in Aicarm in promoting a regulatory solution to simplify and standardize the process of issuing driving licenses for patients with cardiomyopathy. Valerio is a volunteer of the service Hearts Listening for which he offers his experience as a manager and as a patient with cardiomyopathy.
